Grant Money Products Customer Agreement

Grant Money, LLC (“Grant Money”), an affiliate of Kikoff Inc., offers (i) access to certain forms of your already earned income, such as earned wages, before that income is deposited into an eligible bank account (the “Advance”), through the Grant Cash Advance application (the “App”); and (ii) additional features through a paid monthly subscription to Grant Plus, which offers spending insights, budgeting tools, and overdraft and low balance alerts for the deposit account linked to your Grant Money account. Subscription to Grant Plus is not required to request or receive an Advance. This Grant Money Products Customer Agreement (the “Grant Agreement”) governs the Advance services and the Grant Plus subscription that Grant Money may provide to you.

This Grant Agreement is a product-specific Agreement under, and supplements, the Kikoff Master Terms of Service (the “Master Terms”). The Master Terms and the other Agreements governing your use of the App and the services provided by Grant Money — including the Privacy Policy and the Consumer ACH Authorization and Agreement — are incorporated into this Grant Agreement and apply to the Advance and your Grant Plus subscription. Terms defined in the Master Terms or other Agreements have the same meaning in this Grant Agreement unless otherwise defined here. If there is a conflict between the terms in this Grant Agreement and the terms in the Master Terms or any other Agreement, this Grant Agreement will control, but only with respect to the Advance and the Grant Plus subscription and only to the extent of the conflict. The Consumer ACH Authorization and Agreement is set out in full at the end of this Grant Agreement as Part C and forms part of this Grant Agreement.

All Disputes arising out of or relating to this Grant Agreement, the Advance, or your Grant Plus subscription are governed by, and subject to, the Arbitration Agreement, the Class Action Waiver, and the Jury Trial Waiver set forth in Section 17 of the Master Terms, including your right to opt out of arbitration as described there. Please review the Master Terms carefully, as they affect your legal rights.

Part A — Grant Cash Advance (Advance Services)

1. Requirements for Advance Service

To request an Advance, you must have a valid debit card linked to a bank account at a bank located in the United States, and your debit card and linked bank account must be linked to your Grant Money account through the App. You must be physically present in the United States when requesting and receiving an Advance. You must have earned income that is due to you for which you have not received payment from anyone else. You must be at least 18 years of age and must not be prohibited by applicable law or Grant Money from requesting or receiving an Advance.

2. Advance Service

You may request an Advance from Grant Money through the App as long as you do not have an outstanding Advance that is unpaid. If you have an outstanding unpaid Advance or other unpaid charges from Grant Money and request an additional Advance, we will deny your request. Grant Money, in its sole discretion, will determine whether to offer you an Advance amount in response to your request. If we offer you an Advance amount, you may choose to receive an Advance in an amount equal to or less than our offer by selecting the Advance amount and your preferred delivery method. The minimum Advance amount you may select is $25.

3. Receipt of Advance and Optional Expedited Delivery Fee

If you select an Advance amount we offer to you, we will electronically transfer the amount of the Advance to the bank account that you linked to your Grant Money account. When you select the amount of your Advance you have the option to select regular delivery without a delivery fee or expedited delivery for the delivery fee disclosed to you (the “Expedited Delivery Fee”). The Expedited Delivery Fee may range from $2.00 to $25.00, depending on the amount of your selected Advance, and is charged when the Advance is transferred to your bank account and will be repaid when the Advance is repaid. We do not guarantee when the transfer of your Advance will be received and credited to your linked bank account. Advances transferred using regular delivery are typically received within three (3) business days. If you choose to expedite the transfer of your Advance by choosing expedited delivery and agreeing to the Expedited Delivery Fee, transfers using expedited delivery are typically received within an hour, and often, faster.

4. When You Will Be Charged for Advance Repayment

Grant Money will collect the Advance and any Expedited Delivery Fee from your linked bank account(s) and/or debit card(s) using any available payment rail pursuant to the Consumer ACH Authorization and Agreement any time after the later of: (a) the due date displayed to you through the App when you selected the Advance; or (b) any time Grant Money becomes aware of a positive cash inflow into the bank account linked to your Grant Money account even if the funds available in your linked bank account are insufficient to repay the outstanding Advance and Expedited Delivery Fee in full. Grant Money will monitor your bank account balance and attempt to debit funds to repay the Advance and any Expedited Delivery Fee amount when your bank account has sufficient funds to cover the amount of the debit, but Grant Money is not responsible for any overdraft fees, over-the-limit fees, insufficient fund charges (including finance charges, late fees, or similar charges), or other fees or charges that result from debiting your account to repay an Advance and Expedited Delivery Fee.

5. What Occurs In the Event You Fail to Repay the Advance

You have no obligation to repay the Advance or Expedited Delivery Fee. Grant Money has no legal or contractual claim or remedy against you based on your failure to repay an Advance or Expedited Delivery Fee, but you may not request another Advance and we will not grant an additional Advance until your outstanding unpaid Advance and Expedited Delivery Fee are paid in full. If you fail to repay an Advance or Expedited Delivery Fee, Grant Money will not engage in any debt collection activities, place the unpaid amount of the Advance and Expedited Delivery Fee with or sell the unpaid amount to a third party for the purpose of debt collection activities, or report you to a consumer reporting agency. We may send you an email, text or SMS message reminding you of an upcoming payment, but such email, text or SMS message is not and should not be construed as a demand for payment.

Grant Money does not waive its rights to recover funds obtained by fraud or otherwise take actions in response to fraudulent activity, and we will pursue instances of fraud as allowed by law.

Part B — Grant Plus Subscription

6. Subscribing to Grant Plus

The services and products currently available through Grant Plus are outlined in the App. Services and products offered through Grant Plus are subject to change at any time without notice to you.

You can subscribe to Grant Plus through the App. When you subscribe, you agree to pay the monthly fee listed in the App and at https://www.grantcash.com/pricing (the “Fee”) via the bank account or a debit card linked to your Grant Money account (each a “Payment Method”). The Fee will be charged and debited from your bank account using your Payment Method on a monthly basis, starting on the date that you subscribe to Grant Plus, and repeating on the same day of each month until you or we cancel your Grant Plus subscription. If your payment date falls on a day not in the current month, your Payment Method will be charged on the last day of the month. For example, if your payment date is the 31st day of the month but the month only has 30 days, your Payment Method will be charged on the 30th day of that month. If the Fee is not paid by the debit we make to your bank account using your Payment Method, including due to insufficient funds in your bank account, Grant Money will continue to attempt to debit your account using your Payment Method for the Fee amount owed for up to 28 business days.

While Grant Money monitors your account balance and endeavors to ensure sufficient funds before making debits, we cannot guarantee that our debits or debit attempts will not overdraft your bank account or otherwise result in fees from your bank. To avoid potential overdraft or other charges from your bank, make sure the bank account linked to your Payment Method has sufficient funds on your payment date to cover the Fee.

7. Fee Changes

Grant Money will notify you of any increase or decrease in the Fee. An increase in the Fee will be effective for your account starting in the next calendar month that begins at least 30 days after Grant Money sends or posts such notice of the fee increase. A reduction in the Fee will be effective for your account starting in the next calendar month following its reduction.

8. Subscription Cancellation

You may cancel your Grant Plus subscription at any time by emailing support@grantcash.com and notifying us of your intent to cancel. In order to avoid being charged the Fee for the next month’s subscription, you must cancel your subscription at least three (3) business days before your next Fee payment date. If you cancel your subscription within three (3) business days of your next Fee payment date, your subscription will remain in effect for the next month and will cancel the following month. If you cancel your subscription during the month for which your Fee was charged, your subscription will remain active until the end of that monthly subscription period.

9. Credit and Debit Authorization for Fee

If you subscribe to Grant Plus, you authorize Grant Money to electronically debit your Payment Method for the Fee amount each month. You also authorize Grant Money to electronically debit and credit your Payment Method to correct payment errors. You warrant to Grant Money that you have the right to authorize us to debit or credit the bank account linked to your Grant Money account using your Payment Method.

You acknowledge that, as applicable, the electronic authorization contained in this Section represents your written authorization for Grant Money to make the electronic transfers described in this section, including debits and credits, and that this authorization will remain in full force and effect until you notify Grant Money that you wish to revoke it by emailing support@grantcash.com. You acknowledge and agree that debits may not be able to be canceled if they are made less than three (3) business days prior to a scheduled debit and you further agree that if you wish to prevent a scheduled debit from occurring, you will cancel your authorization by emailing support@grantcash.com at least three (3) business days before the date on which the debit is scheduled to occur. If we do not receive notice at least three (3) business days before the scheduled debit date, we may attempt, in our sole discretion, to cancel the transaction. However, we assume no responsibility for our failure to do so.

When you contact us, please include the name and telephone number associated with your account. Failure to provide correct and complete information may make it impossible for Grant Money to cancel or prevent the pre-authorized debit. Revoking your written authorization for electronic transfers will not cancel or reverse payments initiated prior to the receipt of your revocation notice.

If any of the information relied upon in your request to stop payment is incorrect or incomplete, you agree to hold Grant Money harmless from and against losses resulting from the revocation of your authorization for electronic transfers. Note that canceling your Grant Plus subscription or revoking your written authorization for Grant Money to debit your account for the Fee does not terminate or otherwise impact your authorization for us to debit your bank account for the amount of your Advance or Expedited Delivery Fee.

Part C — Consumer ACH and Debit Card Authorization and Agreement

This Part C sets out the Consumer ACH and Debit Card Authorization and Agreement (the “Grant ACH and Debit Card Authorization”) and forms part of this Grant Agreement. It is governed by the Kikoff Master Terms of Service (the “Master Terms”), which are incorporated by reference. Terms defined in the Master Terms or elsewhere in the Grant Agreement have the same meaning in this Part unless otherwise defined here. If there is a conflict between this Part and the general terms above or the Master Terms, this Part controls with respect to the ACH and debit card authorizations set out here and only to the extent of the conflict.

All Disputes arising out of or relating to this Grant ACH and Debit Card Authorization are governed by, and subject to, the Arbitration Agreement, the Class Action Waiver, and the Jury Trial Waiver set forth in Section 17 of the Master Terms, including your right to opt out of arbitration as described there.

I, the User, acknowledge that the “Transfer Funds” feature allows me to transfer funds electronically, as selected by me, either (i) via a debit card transaction (using the debit card number you provided to us) or (ii) via the Automated Clearing House (“ACH”) (using the account and routing number you provided to us) between my eligible account(s) with Grant Money, LLC and my external account(s) at third-party financial institutions (“External Account(s)”), after I have successfully registered my External Account(s). This includes:

  • One-time on-demand transfers, which allow me to initiate multiple, non-recurring, individual transfers based on the transfer date and dollar amount that I request through the Transfer Funds feature of online and mobile banking from time to time;
  • Recurring transfers, which allow me to initiate recurring transfers of a set dollar amount at regular intervals that I have established through the Transfer Funds feature of online and mobile banking; and/or
  • Other ACH and debit card transfer features that Grant Money may make available.

Subject to the terms of the Transfer Funds feature and the terms of the other Agreements with Grant Money, I hereby authorize Grant Money to initiate electronic credit or debit transactions or entries to my registered External Account indicated previously for (a) various amounts at varying times by making on-demand transfers pursuant to my instructions, and/or (b) fixed amount at the frequency I have selected by making recurring transfers pursuant to my instructions (a “Preauthorized Transfer”). If any transfer date falls on a weekend or bank holiday, I understand and agree that the transfer may be executed on the next business day, or as soon as reasonably possible at the discretion of Grant Money.

I hereby represent and warrant that I have all necessary right, power and authority to debit and credit my Grant Money account(s) and any External Account(s) registered, and that all information or instructions that I provide to Grant Money in relation to any ACH or debit card transfer are complete and accurate. I agree that ACH or debit card transactions I authorize comply with all applicable law.

Should an incorrect amount be withdrawn from or deposited to my External Account(s) or my Grant Money account(s), I authorize Grant Money to correct the error by debiting or crediting my External Account(s) or my Grant Money account(s).

This authorization is to remain in full force and effect until Grant Money has received written notification from me of its termination with such time and in such a manner as to afford Grant Money a reasonable opportunity to act on it. For Preauthorized Transfers, I understand that it is my responsibility to contact Grant Money to stop or cancel a Preauthorized Transfer at least three (3) business days prior to the following scheduled payment. In either case, I will send my notice to: support@grantcash.com.

I acknowledge that the origination of ACH transactions must comply with the provisions of applicable law and the rules of the National Automated Clearing House Association (NACHA). I request the financial institution that holds my External Account(s) to honor all transfers initiated in accordance with this authorization form.

I agree to print this Grant ACH and Debit Card Authorization and retain a hard copy or save as an electronic copy. Customer signature collected electronically via the App.
